TERMS & CONDITIONS
This Agreement is a contract between Customer and Oommi Sdn Bhd. By using Oommi Online, the Customer shall be bound by this Agreement and the Terms and Conditions.
The Terms and Conditions are as follow:-
- “Customer” shall mean the person who makes an order to purchase the products using the person’s Login account.
- “Intellectual Property” shall mean all intellectual property rights of whatsoever nature, including (without limitation) patents, designs, present and future trademark or copyright, whether or not registered or registrable by any means, and the right to file an application for registration thereof.
- “Login” shall mean a Customer’s online access to Oommi Online under that Customer’s registration.
- “Product/Products” shall mean any and all the products for sale by Oommi Online.
- “Oommi” shall mean Oommi Sdn Bhd who is the seller of the products by Oommi Online.
- “Oommi Online” shall mean this Internet site and the medium by which Products are offered for sale by Oommi to the Customer.
All Products sold by Oommi through this site are subject to the Terms and Conditions. By submitting the order for processing by Oommi Online, the Customer shall deem to have read, understood and agreed to the Terms and Conditions at the time the order is submitted for processing.
The terms and conditions shall prevail over any other document purporting to have a contractual effect including any store policy at Oommi retail stores.
The Customer shall agree to complete the registration process according to requirements by Oommi as stated on this site. The Customer shall provide Oommi with complete and updated information which shall include (but shall not be limited to) the Customer’s legal name, address, contact number and e-mail address. Registration is open to anyone.
The Customer will be liable for every order made under his/her Login and agrees to indemnify Oommi for all claims, damages whatsoever made by any third party arising from the actions of a person placing orders for the Products using the Customer’s Login. The Customer shall be responsible for updating his/her registration information.

The Customer will receive a confirmation of receipt of order via e-mail.
Free delivery to one location with purchase of MYR100 and above in one receipt. Additional delivery charge may apply for any other special arrangements such as special timing, location, etc.
Access to Oommi Online is through a personal login ID. The Customer shall ensure his/her login ID is kept strictly confidential to prevent unauthorized use. Oommi shall use its best endeavours to prevent any unauthorized entry to the Oommi Online internet site. However, Oommi shall not be liable for any damages or losses whatsoever if any third party gains unauthorized access to the Oommi Online internet site.
The customer registration form must be completed before an order is placed with Oommi Online. The Customer warrants that all information and data provided at the point of registration is accurate, complete and up to date. The Customer shall promptly inform Oommi Online if there is a change to this information or data.
The Customer is responsible for any costs associated with accessing the Oommi Online website and placing an order for goods with Oommi Online, including any Internet provider fees.
In order to purchase goods from Oommi Online, the Customer shall have a Delivery Address within Malaysia. Oommi Online shall not be obliged to deliver goods to an area outside Malaysia.
Oommi shall make every effort to ensure that the prices and details of Products detailed by Oommi Online are correct but Oommi Online reserves the right to vary the price and other details of the Products without notice.
The prices advertised by Oommi Online are applicable at the time the Customer view it. Prices for some Products may not necessarily correspond to the prices at Oommi retail stores or other online store platforms like Lazada or Shoppee. The price of certain Products or Special Bundle Sets may vary subjected to promotional periods on different online store platforms.
Items in the Customer’s order are charged at the purchase price applicable at the time the Customer submits his/her order and as shown on the order confirmation, except:
If an item is out of stock, in which case the customer shall not be charged for that item; and
If the Customer has given instruction to accept a substitute item, in which case the substitute item will be charged at the price at the time the substitute item is scanned for the Customer’s order.
Upon delivery of the items, Oommi Online shall provide the Customer with an invoice specifying the total price for the items.
Payment for Products ordered through Oommi Online can be made with all major credit cards and online banking platforms.
If the Customer’s credit card is declined by its financial institution, Oommi Online reserves the right to refuse delivery of Products to its Customers.
Oommi may change the method of payment for the online orders at any time and such changes may be notified to the Customer via e-mail, phone call, or by placing notice on Oommi Online internet site.
Oommi shall aim to process orders received within 48 hours. Processing time may vary for purchases made during peak periods, over the weekend or on public holidays.
Oommi shall not be held responsible if a delivery arrives late due to any circumstances impacting the availability of the courier service.

Oommi can be delivered to all states in Malaysia.
VARIATION / CANCELLATION OF ORDER
The Customer shall not make any amendment or cancellation once his/her order has been placed.
Subject to the Customer’s consent, Oommi may substitute a Product for another similar Product if the initial Product ordered by the Customer is unavailable.
If there is no prior consent from the Customer for a substitution, then no substitution shall be made. Under this circumstances, Oommi shall make full refund to the Customer as per the Return Policy.
All risk in the Products shall pass to the Customer upon delivery to the Customer’s delivery address but Oommi shall retain title to the Products until such time as payment for the Products has been effected.
RETURNS, EXCHANGES & REFUND POLICY
Returns, exchanges & refunds are NOT ACCEPTED.
However, an exchange may be allowed under the circumstances the item(s) was/were received faulty. The Customer must email Oommi at email@example.com with the order number and pictures of proof. The Customer should not send the purchase back before getting a reply from Oommi. If the exchange request is approved, the Customer shall return the unused faulty item(s) in the original packaging to Oommi and Oommi will ship a replacement order to the Customer without any additional costs.
A refund is only allowed under the circumstances the item(s) ordered is/are no longer available or out of stock.
Oommi’s return, exchange & refund policy lasts 14 days. If 14 days have gone by since the Customer made the purchase, no return, exchange or refund requests under any circumstances will be entertained.
Photographs/designs of the products and packaging are provided on this site to help the Customer to recognise the products. However, the product pictures/designs may be revised and improved as and when necessary without notice.
Oommi shall use its best efforts to ensure that orders are correctly delivered. Should there be any discrepancy, please email to Oommi at firstname.lastname@example.org by the next working day.
The liability of Oommi whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the Products or any other breach of Oommi obligations hereunder shall not in any event exceed an amount equivalent to the price of the Products.
Oommi shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever nor shall Oommi be liable for any damage or loss caused by the Customer’s servants, agents, buyers or other persons whatsoever.
The Products shall be accepted by the Customer entirely at the Customer’s risk.
Oommi owns the trademark, logos and service marks displayed on this site and/or in connection with the Products and Customers. The Customer is prohibited from using the same without the written permission of Oommi or such other parties.
The Customer shall not do anything to prejudice the rights of Oommi.
VARIATION OF TERMS AND CONDITIONS
Oommi reserves the right to amend the Terms and Conditions as and when necessary at its sole discretion. Oommi may, but does not undertake to, notify the Customer of such changes. It is the Customer’s responsibility to review the Terms and Conditions prior to submitting any order and Oommi shall have no responsibility to notify the Customer of any changes to the Terms and Conditions.
These Terms and Conditions shall be governed by the laws of Malaysia and the Customer and Oommi agree to submit to the jurisdiction.
The Customer authorises Oommi to collect, retain and use personal information about the Customer for the following purposes:-
Undertaking any dealings or transactions with the Customer and providing continuous services to the Customer;
Assessing the Customer’s credit-worthiness;
Sending the Customer any advertising and/or promotional material;
Notifying Customers of special offers or new Products;
Notifying Customer of up-dates to this site;
The Customer is aware that in the event sufficient personal information is not supplied, or is not satisfactory to Oommi then his/her application for registration to Oommi Online may not be accepted.
The Customer is aware that any personal information supplied by the Customer will be retained by Oommi and will be accessible to employees of Oommi and other persons or corporate bodies engaged by Oommi for or in relation to any of the purposes listed above, or to third parties and the Customer authorises Oommi to disclose all or any part of any personal information provided by the Customer to such third parties.
The Customer acknowledges that Oommi shall retain all personal information supplied by the Customer and unless otherwise notified to Oommi may continue to contact the Customer with marketing information even after the Customer’s registration is cancelled.
Oommi shall not sell, rent or lease the Customer’s information to third party.
Personal data held by Oommi relating to the Customer shall be kept confidential.
Any questions, comments, suggestions or information other than personal data sent or posted on this site, or any part of this site by the Customer shall deem to have voluntarily provided to Oommi on a non-confidential and non-proprietary basis. Oommi reserves the right to use, reproduce, disclose, transmit, publish, broadcast and/or post elsewhere such information freely, including passing it to any associated company.
Oommi will disclose Customer’s personal data, without notice, only if required to do so by law or in the good faith belief that such action is necessary to:-
Comply with legal process served on Oommi or the site;
Protect and defend the rights or property of Oommi; and
USERNAME & PASSWORD
The Customer shall take responsibility for the safe-keeping of his/her login email ID and password.
The Customer is liable if his/her login email ID and password are used by an unauthorised person. The Customer shall release and indemnify Oommi from any liability arising from the unauthorised use of his/her login email ID or password.
SAFETY OF PERSONAL DATA
All reasonable efforts are made by Oommi to ensure that any personal data held by Oommi is stored in a secure and safe place and no unauthorised access will be made by Oommi to Customer’s browser.
LIMITATION OF LIABILITY
By accessing and using this Oommi Online internet site, the Customer acknowledges and accepts that the use of the site is at the Customer’s own risk. Oommi shall not be liable for any direct, indirect, incidental,
consequential or punitive damage or for damages for lost profits or for loss of revenue arising out of any use of, access to, or inability to use the site. Without limiting the foregoing: THIS SITE AND ALL INFORMATION AND MATERIALS CONTAINED IN IT ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OR IMPLIED TERMS AS TO TITLE, QUALITY, MERCHANTABILITY, FITNESS FOR PURPOSE , PRIVACY OR NON-INFRINGEMENT. OOMMI HAS NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENTS OF THE SITE. OOMMI ASSUMES NO RESPONSIBILITY AND SHALL NOT BE LIABLE (TO THE EXTENT PERMITTED BY LAW) FOR ANY DAMAGE OR INJURY ARISING OUT OF ANY USE OF OR ACCESS TO THE SITE/CATALOGUE, OR ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, INTERCEPTION OF ONLINE COMMUNICATION, SOFTWARE OR HARDWARE PROBLEMS (INCLUDING WITHOUT LIMITATION LOSS OF DATA OR COMPATIBILITY PROBLEMS), THEFT, DESTRUCTION OR ALTERATION OF THE SITE, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOUR, NEGLIGENCE OR, UNDER ANY OTHER CAUSE OF ACTION RESULTING DIRECTLY OR INDIRECTLY FROM ANY ACCESS OR USE OF THE SITE/CATALOGUE, OR ANY UPLOADING, DOWNLOADING OR PUBLICATION OF DATA, TEXT, IMAGES OR OTHER MATERIAL OR INFORMATION TO OR FROM THE SITE.
